1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the website abspedidos.com and the ABS Pedidos ordering and customer-management application (collectively, the "Service") operated by ABS Beauty Distributor LLC ("ABS Pedidos", "we", "us"). By using the Service you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service.

3. Orders and Payment

Orders placed through the Service are offers to purchase and are subject to acceptance by ABS Pedidos. Prices, availability and promotions may change without notice. Payments are processed by Stripe and, when applicable, ACH transfers initiated via Plaid.

4. SMS / Text Messaging Terms

By providing your mobile phone number and checking the SMS consent box at checkout, you expressly consent to receive recurring transactional SMS text messages from ABS Beauty Distributor relating to your orders (order confirmations, delivery updates, payment receipts, and account notifications).

• Message frequency: Message frequency varies based on your order activity. You may receive up to 5 messages per order.
• Cost: Message and data rates may apply depending on your mobile carrier and plan. ABS Pedidos does not charge you for SMS messages.
• Opt-out: You can cancel the SMS service at any time by replying STOP to any message we send you. After you send STOP, we will send you a confirmation message and you will no longer receive SMS messages from us. If you want to opt back in, sign up as you did the first time.
• Help: Reply HELP at any time for assistance, or email support@abspedidos.com.
• Carriers: Carriers, including but not limited to T-Mobile, AT&T, Verizon, Sprint, US Cellular, Boost, Metro PCS, and others are not liable for delayed or undelivered messages.
• Supported carriers: SMS messages are available on all major U.S. carriers.
• Privacy: We will never share, sell, or rent your mobile phone number or SMS consent to any third party for marketing purposes. See our Privacy Policy for details on how we handle your data.

5. Acceptable Use

You agree not to misuse the Service, including but not limited to attempting to interfere with security, accessing data not intended for you, or using the Service for any unlawful purpose.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free.

7. Limitation of Liability

To the maximum extent permitted by law, ABS Pedidos will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
